Australian Court Demands Apple to Show ‘proof’ on claim #patentfun
So to add to the patent litigation extravaganza, the Australian court is now asking Apple to show proof that the Galaxy Tab has hurt the iPad sales.
A few weeks back, Apple had petitioned to ban the Galaxy Tab sales in Australia (as they have in Germany, which they won in that case, getting Samsung to even remove any mention of it at the IFA — despite having misled the judge on the size).
Now a judge has come back and said that Apple needs to provide proof of their claim. Leave it to the Aussies to have the gonads to stand up to Apple. [I guess those Germans were already on the 'outs' with Google]
“Unless Apple puts on evidence showing the impact in the U.S. or U.K., I can’t draw any positive assumptions,” Federal Court Justice Annabelle Bennett said in Sydney.
